Legal and Ethical Implications of the Over Criminalization of Illegal Immigrants in the United States (Tema Central)

Description: The aim of this review is to explore the consequences of the incorporation of criminal law into immigration enforcement. It will argue that the measures accompanying this criminalization of migration undermine human rights and legal principles. This essay first provides a brief view of the contemporary patterns of migration. Second, it analyses the shift that has occurred in international migration law from the civil to the criminal realm, drawing on the illustrative example of Latin American immigration into the United States. Finally, it suggests some challenges that both domestic and international law are facing and the importance of these from a criminological point of view.
Este artículo tiene como objetivo explorar las consecuencias de la incorporación del Derecho Penal en la observancia de la inmigración. Se argumenta que las medidas que acompañan esta penalización de la migración socavan los derechos humanos y principios legales. En primer lugar la investigación provee una rápida revisión de los patrones de migración contemporánea. En segundo lugar, analiza el cambio que ha tenido lugar en las leyes de migración internacional, pasando del ámbito civil al penal, tomando como ejemplo ilustrativo la migración de América Latina hacia los Estados Unidos. Finalmente, se sugieren algunos retos que tanto las leyes domésticas como internacionales están enfrentando y la importancia de estas desde un punto de vista penal.
