Las relaciones normativas entre la OMC y dos mecanismos regionales de América Latina (Tema Central)

Description

The reemergence of open regionalism in recent years has fostered a new scenario in Latin America characterized by greater trade liberalization. Within this context, the World Trade Organization ensures that trade flows as smoothly, predictably and freely as possible, and determines the rules that govern international trade. Based on the open regionalism and notified as regional trade agreements in the multilateral trade system, the Pacific Alliance and the Andean Community proceed according to Article XXIV of the WTO. Article XXIV determines that regional mechanisms focused on a commercial agenda must facilitate trade between its member countries, and not create obstacles to it. In this way, the WTO and a regional mechanism can keep a linkage. This research argues that while the Pacific Alliance and the WTO are formally linked, the Andean Community and the WTO are indirectly linked.
El retorno del regionalismo abierto ha impulsado un nuevo escenario caracterizado por una mayor liberalización comercial en América Latina en los últimos años. En este escenario, la Organización Mundial del Comercio asegura que los intercambios comerciales tengan lugar de la forma más fluida, previsible y libre posible y determina las normas que rigen el comercio internacional. La Alianza del Pacífico y la Comunidad Andina, basados en la lógica del regionalismo abierto y notificados como acuerdos regionales comerciales en el sistema multilateral de comercio, deben estar vinculados con el artículo XXIV de la OMC. El artículo XXIV determina que los mecanismos regionales con foco en temas comerciales deben facilitar el comercio entre sus países miembros y no crear obstáculos al mismo. Esta investigación argumenta que, mientras la Alianza del Pacífico y la OMC se encuentran formalmente vinculadas, la Comunidad Andina y la OMC se interconectan, de manera indirecta.
