Análisis de las razones en los casos de negativas de inscripción en el Registro de la Propiedad del cantón Cuenca

En el presente trabajo de investigación se determina si al momento de realizar la calificación registral, se tuvo una adecuada aplicación a la Ley, con el objetivo de realizar un análisis de la fundamentación que emite La Registradora de la Propiedad del cantón Cuenca en cada nota devolutiva de inscripción, se determina la importancia de la motivación en cada devolutiva, consistente en razonamientos de hecho y de derecho, que contenga elementos críticos, lógicos y de valor. A través de un análisis realizado a las notas devolutivas, comprendidas en febrero del 2018, se determinó que varias notas devolutivas no cumplen con lo establecido en la Constitución, respecto a la motivación, por lo que se propone a la Registradora de la Propiedad tomar en cuenta las devolutivas que emite, a los usuarios reclamar el incumpliendo de la norma y la arbitrariedad de la misma, por lo que se debería considerar nulas algunas devolutivas.
In the current research work it is determined if at the moment of making the registry qualification, there was an adequate application to the Law, with the objective of carrying out an analysis of the foundation issued by the Property Register of Cuenca canton in each return note of registration, the importance of the motivation in each devolution is determined, consisting of reasoning of fact and law, containing critical, logical and valuable elements. Through an analysis made to the return notes, included in February 2018, it was determined that several return notes do not comply with the requirement established by the Constitution, regarding to the motivation, at which it is proposed to the Property Register to take into account the returnable that it issues, to the users to claim the breach of the norm and the arbitrariness itself, so it should be considered null some return notes.
