"Este trabajo investigativo sobre el “Abandono procesal” y sus efectos con el COGEP frente a un análisis comparativo con la anterior legislación procesal, se basa en la importancia que tiene la Legislación Ecuatoriana Procesal Civil en garantizar el respeto de los fundamentos legales y procesales, este trabajo se realiza en las Unidades Judiciales Civiles de la Ciudad de Cuenca y con esto determinar si existe una vulneración de derechos. Con el COGEP en el Ecuador se han generado cambios en la sustanciación de los juicios, por ello es necesario conocer los efectos que ha causado la figura jurídica del abandono establecido en este cuerpo normativo procesal en materias no penales, saber si la normativa atenta contra bienes jurídicos y el acceso a la justicia; y si llega a dejar en indefensión a los titulares de derechos, vulnerando la tutela judicial efectiva y la seguridad jurídica establecida en la Constitución. "
This research work addresses the "procedural abandonment" and its effects along with the COGEP faces a comparative analysis to the previous procedural legislation, it is based on the importance of the Ecuadorian Civil Procedure Legislation which guarantees to respect the legal and procedural foundations, this Work is carried out in the Civil Judicial Units of the City of Cuenca and with this, determine whether there is a violation of rights. With the COGEP in Ecuador changes in the substantiation of trials have been generated, therefore, it is necessary to know the effects caused by the legal figure of abandonment established in this body of procedure about non-criminal matters, in order to know whether the regulations are against property legal rights and access to justice; and if it comes to leave defendants in defenselessness, violating effective judicial protection and the legal security established in the Constitution.
