Este trabajo investigativo tiene por finalidad establecer el tiempo oportuno para que el Procedimiento Abreviado pueda ser propuesto no solamente ante el Juez Unipersonal de la Unidad Judicial sino ante el Juez Pluripersonal. Se plantea en el Código Orgánico Integral Penal que este procedimiento se debe realizar ante el Juez de Garantías Penales, sin embargo, formulamos la hipótesis de que es oportuno y constitucionalmente procedente proponer la aplicación de este procedimiento en forma previa al juzgamiento ante el Tribunal de Garantías Penales. Para ello se exponen fundamentos legales, constituciones y doctrinarios que avalan su factibilidad y constitucionalidad. Confrontada la hipótesis con la problemática y bajo la aplicación del método analítico-sintético se alcanzó los objetivos que esencialmente persigue el Derecho Penal: la paz social y el resarcimiento integral de derechos de la víctima.
This investigative work has the purpose of establishing the opportune time so that the Abbreviated Procedure can ben proposed not only before the Unipersonal Judge of the Judicial Unit but before the Pluripersonal Judge. It is stated in the Comprehensive Criminal Organic Code that this procedure must be performed before the Judge of Criminal Guarantees, however, we formulate the hypothesis that it is timely and constitutionally appropriate to propose the application of this procedure prior to trial before the Court of Guarantees Penalty In order to do so, legal constitutional an doctrinal foundations that guarantee its feasibility and contitutionality are exposed. Confronted the hypothesis with the problematic and under the application of the analytical-synthetic method was achieved the objectives that essentially pursue the Criminal Law: social peace and comprehensive compensation for the rights of the victim.
