La motivación en las resoluciones de medidas de protección dictadas por la Junta Cantonal de protección de derechos del Cantón Cuenca durante el período 2016

En el presente trabajo de investigación, se analiza la motivación en las resoluciones sobre las medidas de protección dictadas por "La Junta Cantonal de Protección de Derechos del Cantón Cuenca", con el objetivo de determinar si estas medidas de protección son debidamente motivadas por estos jueces administrativos. A través de un análisis de casos sobre violencia física, psicológica y bullying obtenidos de la Junta Cantonal de Derechos en el año 2016, se pudo determinar que las resoluciones no cumplen con los parámetros establecidos por la Corte Constitucional, relativos a la garantía de la motivación. Se propone que los jueces administrativos tomen en cuenta el material probatorio, con el fin de evaluar cada elemento de prueba, y en caso de no presentar los elementos probatorios se debería considerar nula o sin fundamentación la demanda.
In the present research work, the grounds in the resolutions on the measures of protection dictated by "Cuenca Cantonal Board of Tights Protection" is analyzed, in order to determine if these protection measures are duly motivated by these administrative judges. Through an analysis of cases of physical, psychological and bullying violence obtained from the Cantonal Rights Board in 2016, it was able to determine that the resolutions do not comply with the parameters established by the Constitutional Court, regarding the guarantee of the grounds. it is proposed that the administrative judges take into account the supporting evidence, in order to evaluate each element, and in case of not presenting the probative elements, the claim should be consiered null or without justication.
