En el presente trabajo, la investigación se centra en el análisis de la jurisprudencia de la Corte Constitucional, respecto de sus pronunciamientos, en cada caso que se han presentado a dicha magistratura, en materia de Derechos de la Naturaleza, considerando la declaratoria, su aplicación y mecanismos que garanticen el cumplimiento de tales derechos. Para tal efecto, se realiza un análisis que considera no solo los pronunciamientos de la Corte sino también, se consideran primero, los conceptos y concepciones dogmáticas respecto de la Naturaleza con aportes de la sociedad mestiza actual y aportes de las culturas milenarias indígenas, y segundo, la normativa legal vigente en el país que nos determina generalidades sobre los derechos e implicaciones de los mismos. Se busca también, poder encontrar de forma normativa, mecanismos idóneos y aplicables que se encuentren ya positivizados y que nos permitan el pleno ejercicio de los derechos de la naturaleza, así como también, la protección efectiva de la misma en caso de vulneraciones.
In this paper, the research focuses on the analysis of the jurisprudence of the Constitutional Court, concerning its pronouncements, in each case that has been presented to the said magistracy, in matters of Rights of Nature, considering the declaration, its application, and mechanisms that guarantee the fulfillment of such rights. To this effect, an analysis is made that considers not only the pronouncements of the Court but also, first, the concepts and dogmatic conceptions regarding Nature with contributions from the current mestizo society and grants from the millenary indigenous cultures, and second, the legal regulations in force in the country that determine generalities about the rights and implications of the same. Suitable and applicable mechanisms that are already positive and allow to fully exercise the Rights of Nature and its adequate protection in case of violations are sought to find.
