La inaplicabilidad del artículo 178 del Código Orgánico Integral Penal en la difusión de videos sexuales filmados con consentimiento de la víctima

En el siguiente trabajo de titulación se analiza el alcance del apartado 178 del Ordenamiento jurídico penal para determinar quiénes pueden ser susceptibles de sanción por el delito de violación a la intimidad por difusión de contenido sexual, además de delimitar los requisitos del apartado 178 del COIP para determinar los requisitos que configuran la tipificación de este delito y los mecanismos que poseen las victimas frente a los delitos informáticos. Dentro del presente análisis se verificará la existencia o no de una violación al derecho a la intimidad con base en la normativa internacional y nacional que respalda la intimidad de todas las personas a fin de proteger sus datos personales y su esfera íntima, finalmente a través de los métodos investigativos correspondientes al enfoque de investigación cualitativo de carácter descriptivo y documental se conocerá si es necesario proponer una reforma al apartado 178 del COIP en base a la protección que requiere el derecho a la intimidad.
In the following qualification work, the scope of article 178 of the Comprehensive Organic Criminal Code is analyzed to determine who may be subject to sanction for the crime of violation of privacy due to the dissemination of sexual videos, in addition to defining the requirements of paragraph 178 of the COIP to determine the requirements that make up the classification of this crime and the mechanisms that victims have against computer crimes Within this analysis, the existence or not of a violation of the right to privacy will be verified based on international and national regulations that supports the privacy of all people in order to protect their personal data and their intimate sphere, finally through the investigative methods corresponding to the qualitative research approach of a descriptive and documentary nature, it will be known if it is necessary to propose a reform to section 178 of the COIP in order to protect the right to privacy.
