Este trabajo de investigación se encamina hacia los derechos de los trabajadores al momento de un despido intempestivo, el Código de Trabajo establece el despido ineficaz como una garantía hacia un determinado grupo de personas, que permite al trabajador escoger entre reincorporarse a sus labores o en su defecto recibir las indemnizaciones correspondientes. En la investigación se realiza un análisis separado del despido intempestivo, la forma de declarar ineficaz y a quienes beneficia esta figura legal; de la misma forma se determina cuáles serían los derechos que se les garantizarían a las personas objeto del estudio. Concluyendo que, la normativa laboral actual no establece el beneficio del despido ineficaz para las personas trabajadoras que aun padeciendo de enfermedades catastróficas cuentan con la vitalidad de trabajar, evidenciando la plena necesidad de incorporar una reforma al Código del Trabajo para establecer este beneficio en favor de este grupo de atención prioritaria.
