La investigación que se presenta bajo la modalidad de artículo académico, analiza la Opinión Consultiva CIDH Número OC-24/17 frente al matrimonio igualitario, derivado de la vulneración de derechos a causa de la antinomia constitucional en el aceptación del matrimonio entre personas del mismo sexo en el Ecuador, esto considerando que el país es miembro activo de la Organización de Estados Americanos. Para esto fue necesario estudiar los fundamentos teóricos derivados de la antinomia en función del artículo 67 de la Constitución, así como la negativa a celebrar el mismo en la provincia de Azuay, en las sentencias de primera y segunda instancia de los casos N° 01204201803635 y 01204201803637, respecto al matrimonio igualitario. El autor concluye que la vía más expedita para lograr avanzar en materia de derechos humanos de las personas pertenecientes a la comunidad LGTBI, sería reformar el inciso dos del artículo 67 de nuestra Constitución.
The research that is presented under the academic article modality, analyses the Consultative Opinion CDIH Number OC.24/17 in face to the marriage equality, which derives from the vulnerability of the civil rights caused by the constitutional antinomy in the recognition of marriage equality in Ecuador, this is, considering that our country is an active member of the American States Organization. For such end, it was necessary to study its theoretical background derived from the antinomy in function of the 67 article in the Constitution, as well as the negativity to celebrate it in the Azuay province in the judgments of first and second instance of the cases number 01204201803635 and 01204201803637, in respect to the marriage equality, the author concludes that the fastest way to advance on civil rights matter of the people from the LGTBL community would be to reform the subsection two of the 67 article of our Constitution.
