Análisis de la falsedad ideológica del art. 198 del Código Orgánico General de Procesos Ecuatoriano.

La alteración de documentos, actualmente podemos considerarlo un delito silencioso dado que en muchas ocasiones no ha salido a la luz, se ha generado nuevas formas de cometer este ilícito, por ende, se hace necesario que se habrán nuevos caminos que viabilicen la investigación sin que se requiera un trámite previo. En el ámbito jurídico, según el Art. 207 del COGEP, el documento público agregado al proceso con orden judicial y notificación a la parte contraria, constituye prueba legalmente actuada, haremos especial énfasis, en lo que respecta a la falsedad documental, que es considerada como la falta de autenticidad que produce nulidad de los actos jurídicos, sobre todo abordaremos como la ley civil se enfoca para su tramitación hasta obtener una sentencia que sirva de base para alcanzar la vía penal. La presente investigación es de carácter cualitativo, basándome en entrevistas a jueces, fiscales y abogados, apoyados en la doctrina.
The alteration of documents, currently we can consider it a silent crime since in many cases it has not come to light, new ways of committing this illicit have been generated, therefore, it is necessary that there will be new paths that make the investigation viable without a previous procedure is required. In the legal field, according to Art. 207 of the COGEP, the public document added to the process with a court order and notification to the opposite party, constitutes legally acted evidence, we will place special emphasis, in regard to the documentary falsification, which is considered as the lack of authenticity that produces nullity of legal acts, especially we will address how the civil law focuses for processing until obtaining a sentence that serves as a basis to reach the criminal route. The present investigation is of a qualitative nature, based on interviews with judges, prosecutors and lawyers, supported by the doctrine.
