La legislación ecuatoriana es bastante clara en lo que respecta a la protección de los derechos de los menores, a pesar de ello, no consagra dentro del ordenamiento jurídico un procedimiento expreso para el tema de la recuperación de los menores y menos cuando estos se encuentran en el extranjero, a consecuencia de ello las autoridades Judiciales en materia de familia se encuentran obligados a interpretar la norma en la toma de sus decisiones, vulnerando así el interés superior del menor. Cabe destacar que al no haber un procedimiento expreso las acciones para recuperar al menor no siempre son las más efectivas, es por ello que en el desarrollo del presente trabajo investigativo se pretende realizar un análisis de los perjuicios causados para los progenitores pero sobre todo para el menor, así como también se analizara la legislación actual y vigente que rige nuestro país para plantear alternativas y soluciones que en la práctica resulten eficientes para recuperar al menor sin afectarle y sobre todo garantizando el pleno desarrollo de sus derechos
Ecuadorian legislation is quite clear regarding the protection of the rights of minors, despite this, it does not enshrine within the legal system an express procedure for the issue of the recovery of minors and less when they are in custody. abroad, as a result of this, the Judicial authorities in family matters are obliged to interpret the norm in making their decisions, thus violating the best interests of the minor. It should be noted that in the absence of an express procedure, the actions to recover the minor are not always the most effective, which is why in the development of this investigative work it is intended to carry out an analysis of the damages caused to the parents but especially to the minor, as well as the current and current legislation that governs our country will be analyzed to propose alternatives and solutions that in practice are efficient to recover the minor without affecting him and above all guaranteeing the full development of his rights
