El presente trabajo de titulación tiene como principal objetivo determinar la vulneración a los derechos de las personas con discapacidad en el cumplimiento de la prestación de alimentos para los niños, niñas y adolescentes sin que exista un procedimiento propio para el efecto en el Código Orgánico de la niñez y adolescencia, el cual busca brindar un aporte a la sociedad ecuatoriana, referente a la protección de derechos, partiendo del diagnóstico de esta realidad jurídica social se utilizó una metodología bibliográfica-documental basada en el análisis de Doctrina, Normativa nacional e internacional, Tratados y Convenios Internacionales. Dentro de esta investigación también se aplicó el método Histórico-Lógico que conllevo a permitir el análisis de bibliografías, teorías, leyes, estableciendo de esta manera la vulneración del principio de acción afirmativa de las personas obligadas a la prestación de alimentos al no encontrarse tipificado este hecho como incidente para establecer el monto por concepto de pensión alimenticia.
The main aim of this thesis is to determine the violation of the rights of people with disabilities in the fulfillment of the provision of food for children and adolescents without the existence of an appropriate procedure for this purpose in the Organic Code of Children and Adolescents, which seeks to contribute to Ecuadorian society, in terms of protection of rights, based on the diagnosis of this social legal reality. A bibliographic-documentary methodology has been used, based on the analysis of doctrine, national and international regulations, international treaties, and conventions. Within this research, the historical-logical method was also applied, which led to the analysis of bibliographies, theories, and laws, in this way establishing the violation of the principle of positive action of the persons obliged to provide alimony, since this fact is not typified as an incident to determine the amount of alimony.
