Dentro de la estructura estatal se busca garantizar los derechos de todos los habitantes del Estado, esto debe entenderse como el amparo legal, del que gozan los ciudadanos, seres vivos de la especie humana y también los seres que en conjunto conforman la Pacha Mama; el Código Orgánico Integral Penal es la normativa que se encarga de sancionar las conductas típicas, antijurídicas y culpables que vulneran los bienes jurídicos tutelados, siendo la Pacha Mama sujeto de derecho y protección se han tipificado conductas para amparar los derechos de esta y sus habitantes, pero la problemática surge en el amparo de los derechos fundamentales de la fauna urbana, nombre con el que se conoce a los animales de compañía cuya existencia y bienestar depende del ser humano, ya que existe una limitante por la forma de conocer la infracción, pues no se consideran delitos de acción penal pública lo cual aumenta el riesgo de la salud y vida de estos animales, que imposibilitados del habla deben esperar que exista una querella previa, para que inicie el proceso de acción penal privada que ampara sus derechos y sancionará al agresor, ya que el accionar policial se ve limitado en estos casos, por cuanto a pesar de existir actualidad de la conducta, no se puede actuar de oficio; lastimosamente la falta de recursos y el temor a las represalias contribuyen para que estos hechos queden en la impunidad.
As part of the state structure, the aim is to guarantee the rights of all the inhabitants of a state; this implies the legal protection of citizens, living beings, and the creatures that are part of the Pachamama (Mother Earth). The Organic Integral Penal Code is the norm that is responsible for sanctioning typical, unlawful, and guilty behaviors that vulnerate the protected legal goods since the Pachamama is a subject of rights and protection. There have been typified behaviors to protect the rights of Mother Earth and its inhabitants, but problems have arisen in protecting the fundamental rights of urban fauna. That is a name given to companion animals whose existence and welfare depend on human beings, as there is a limitation in knowing the infraction, since they are not considered crimes of public criminal action, which increases health and life risks for these animals. As they are unable to speak, they must wait for the prior filing of a lawsuit to initiate the private criminal action process that protects their rights and sanctions the aggressor, since police action is limited in these cases. Althoug it is an ongoing behavior; it is not possible to act ex officio. Unfortunately, the lack of resources and the fear of reprisals contribute to the impunity of these acts.
