El derecho a la pensión alimenticia es una figura jurídica que incluye todos los aspectos que coadyuvan al óptimo desarrollo del niño, niña y adolescente: alimentación, vestimenta, vivienda, salud, recreación y educación. El Código de la Niñez y Adolescencia establece que el derecho de alimentos cesa al cumplir la mayoría de edad, o hasta los veintiún años cuando el alimentado continúa sus estudios. Este límite se ha fundado en la presunción de hecho según la cual el alimentado al cumplir esta edad puede auto sustentarse; sin embargo, esto no refleja la realidad socio-jurídica. En la práctica, muchos estudiantes que han cumplido veintiún años no se encuentran en condiciones de trabajar y estudiar al mismo tiempo para solventar los gastos inherentes al estudio universitario. Por ello, resulta necesario reformar el Código de la Niñez y Adolescencia para extender el derecho de alimentos hasta la culminación de los estudios universitarios del alimentado.
The right to alimony is a legal figure which covers all aspects designed to ensure an optimum level of child and adolescent growth and well- being: feeding, apparel, housing, health, leisure and education. The Childhood and Adolescence Code states that the right to alimony ends on reaching legal age, or until the age of twenty- one when the individual continues his or her studies. This boundary is based on the assumption of fact that individuals when they reach this age are able to provide for themselves; however, this does not correspond to socio- legal reality. In practice, many twenty- s are not in a status to work and study at the same time in order to cover the expenses inherent in studying at university. This is why it is important to amend the Childhood and Adolescence Code in order to extend the right to alimony up to the end of his or her university studies.
