Los delitos en contra de la ley de propiedad intelectual en la legislación ecuatoriana.

En esencia, la propiedad intelectual es el derecho que se confieren a las personas sobre las creaciones de su mente, esto implica que tiene el derecho a usar, gozar y disponer de un bien, es decir es un tipo especial de dominio, y que tiene por objeto la protección de bienes intangibles, por lo tanto a éste derecho se le ha otorgado un lugar privilegiado como motor del desarrollo económico, bienestar social y cultural de los pueblos, además como incentivo a la inversión, y generador de nuevas ideas. Siendo un derecho patrimonial, la propiedad intelectual, es imperante protegerla, y hacerla valer frente al Estado. Su modificación y aplicación, serán integrales, referente a las penas y sanciones, (igualdad en proporcionalidad), y así combatir la piratería, falsificaciones y la competencia desleal.
In essence, intellectual property is the right to be given to persons over the creations of their minds, this implies that it has the right to use, enjoy and dispose of property, it is a special type of domain, and has designed for the protection of intangible assets therefore right to it has been granted a privileged place as an engine of economic development, social and cultural welfare of the people, as well as an incentive to investment, and generate new ideas. Being a property right, intellectual property, it is imperative to protect and enforce it against the State. The modification and application, will be integral concerning penalties and sanctions, (equal proportionality), and thus combat piracy, counterfeiting and unfair competition.
