Este trabajo de investigación contiene aspectos relevantes respecto del Reconocimiento del derecho humano al agua en la Constitución de la República y la relación que tiene el sumak kawsay con el derecho humano al agua; así como también se realiza una indagación sobre los aportes de los instrumentos internacionales y la influencia que tuvieron estos marcos jurídicos tanto en la región como en el Ecuador en materia de derechos humanos, así mismo se realiza un análisis de la problemática y los acontecimientos sociales surgidos tanto en la región como en el Ecuador en torno a la distribución inequitativa, la contaminación y el acaparamiento del agua, evidenciada en gran magnitud durante la época neoliberal de los 90; así como también se realiza un análisis en torno a la carente institucionalidad que ha dado paso a grandes injusticas en nuestro país y finalmente se intenta buscar respuestas a una crisis sociopolítica suscitada en el Ecuador en cuanto a la aprobación de la nueva Ley de aguas.
This research work contains relevant aspects on the acknowledgement of human right to get access to water, provided in the Constitution of the Republic and the relation of sumac kawsay with the human right to get access to water. There is also an investigation on contributions by international instruments and the influence of juridical settings on the region and Ecuador on human rights. There is also an analysis of the problematic ans social events occurred in the region and Ecuador on inequitable distribution, contamination and hoarding of water, occurring in a great deal during the 90´s neoliberal age, as well as an analysis on the scarce institutionalism that have given way to great injustices in our country and search for responses to a sociopolitical crisis occurred in Ecuador regarding the approval of the new law Water.
