La Constitución de la República del Ecuador reconoce la importancia del derecho que tienen las personas al acceso a una tutela judicial efectiva, imparcial y expedita, en la cual comprende derechos fundamentales como el derecho que tienen las personas a presentar pruebas para justificar sus alegaciones y que estas sean una de las consideraciones principales para la toma de decisiones por parte de los Jueces encargados de administrar justicia. En este sentido, contamos con una legislación que regula el ámbito procesal civil y en particular la actividad probatoria, entre ellas, la prueba testimonial, la cual es objeto del presente trabajo, aquella que considero necesario comentar y observar aspectos importantes que serán de gran utilidad para determinar ciertas debilidades encontradas en el capítulo de la prueba testimonial que establece el Código Orgánico General de Procesos, precisamente con relación a los aspectos que trata sobre los testigos, los interrogatorios y la valoración de dicha prueba de cara a la importancia de la aplicación de las reglas de la sana crítica y de las máximas de experiencia de los Jueces.
The Constitution of the Republic of Ecuador recognizes the importance of the right people have access to an effective, impartial and expeditious judicial protection, which includes fundamental rights such as the right of people to produce evidence to substantiate their claims and these are one of the main considerations for decision making by judges responsible for administering justice. In this regard, we have a law governing the civil procedural scope and in particular the presentation of evidence, including the testimony, which is the subject of this paper, which I consider necessary to comment and observe important aspects that will be very useful to determine certain weaknesses found in the chapter of the testimonial evidence that establishes the General Organic Code of Processes, precisely in relation to the aspects dealing with the witnesses, the interrogations and the evaluation of said evidence in view of the importance of the application of the rules of sound criticism and the maxims of experience of the Judges.
