Derecho a la desconexión laboral : su reconocimiento jurídico para los trabajadores en general.

La presente investigación analiza la importancia de la introducción de la figura del Derecho a la Desconexión laboral en la legislación Ecuatoriana, en el marco del trabajador en general; figura que pretende evitar que el trabajador sea requerido por el empleador fuera de su jornada laboral y que de esta forma no se prolongue su jornada de forma ilegal. Es así, que bajo esta nueva figura el Estado podrá cumplir su deber de garantizar y proteger los derechos básicos del trabajador vulnerados al imponérsele la realización de actividades laborales por medios digitales de forma extemporánea, derechos cómo el descanso, intimidad, salud, justa remuneración entre otros que se encuentran intimamente relacionados y que serán abordados. Conoceremos así, que no basta con las figuras ya existentes en nuestro marco jurídico, para garantizar la protección de los derechos mencionados y en consecuencia la necesidad de reconocer el derecho a la desconexión laboral para todos los trabajadores en nuestro ordenamiento jurídico.
The present investigation analyzes the importance of the introduction of the figure of the Right to Labor Disconnection in the Ecuadorian legislation, in the field of the worker in general; figure that seeks to prevent the worker from being required outside of his working day, and thus not extend his day illegally. Thus, under this new figure, the State will fulfill its duty to guarantee and protect the basic rights of the violated worker by imposing the performance of work activities by digital means extemporaneously; rights such as rest, privacy, health, fair remuneration among others that are closely related and will be addressed. We will know that the figures already existing in our legal framework are not enough to guarantee the protection of known rights and, consequently, the need to recognize the right to disconnection from work for all workers in our legal system.
