El presente proyecto investigativo tiene como objetivo fundamental el análisis legal sobre la posible existencia de Unión de hecho en menores de edad emancipados, en nuestra normativa ecuatoriana, debido a la inobservancia y/o vacío legal en su legislación vigente, perteneciente al artículo 68 de la Constitución de la República del Ecuador, en concordancia con el artículo 222 del Código Civil, mismos que hacen referencia a la figura jurídica de unión de hecho. En este sentido, el presente trabajo analiza la unión de hecho, sus antecedentes, conceptos, características y requisitos, además también de analizar el concepto de emancipación en jóvenes y su capacidad jurídica para consentir actos, a efectos de proceder al análisis de unión de hecho entre jóvenes emancipados; y de esta manera considerar necesario y/o pertinente una reforma normativa al artículo 222 del Código Civil, mediante la cual se permita este acto jurídico, siempre que además se dé cumplimiento a los otros requisitos que la Ley prevee para la configuración o existencia de Unión de Hecho.
The main objective of this research project is the legal analysis of the possible existence of de facto union in emancipated minors, in our Ecuadorian legislation, due to the nonobservance and/or legal void in its current legislation, pertaining to Article 68 of the Constitution of the Republic of Ecuador, in accordance with Article 222 of the Civil Code, which refer to the legal figure of de facto union. In this sense, this paper analyzes the de facto union, its background, concepts, characteristics and requirements, in addition to analyzing the concept of emancipation in young people and their legal capacity to consent to acts, in order to proceed to the analysis of de facto union between emancipated young people; and thus consider necessary and/or relevant a regulatory reform to Article 222 of the Civil Code, by which this legal act is allowed, provided that the other requirements that the Law provides for the configuration or existence of de facto union are also fulfilled.
