El principio de inocencia está considerado como la máxima garantía que tiene una persona en la sustanciación de un proceso, sin embargo existen circunstancias que pueden llegar a vulnerar esta garantía constitucional, una de ellas y la cual es motivo del presente estudio, es el uso desmedido de la medida cautelar de prisión preventiva en nuestro país, misma que al momento de ser emitida de parte del órgano de justicia competente produce un atentado a este principio, puesto que se priva de la libertad a una persona que es inocente debido a que no hay una sentencia de por medio que pruebe su responsabilidad. El objetivo de este trabajo es que se produzca un cambio en la forma de impartir justicia en el Ecuador, que las decisiones que tomen los jueces sean de una manera responsable y respetando los principios, derechos y garantías que la Constitución de la Republica les reconoce a todos los ciudadanos que habitamos el territorio nacional.
The presumption of innocence is considered the maximum warranty having a person in the conduct of a process, however there are circumstances that may violate this constitutional warranty, one and which is the reason for the present study, it is the excessive use of the measure precautionary pre-trial detention in our country, same to be issued on the part of the competent justice authority when it produces an attack on this principle, which is deprived of freedom to a person who is innocent because there is not a sentence of through proving their responsibility. The objective of this work is that you there is a change in the form of administering Justice in the Ecuador, that the decisions taken by the judges to be in a responsible manner and respecting the principles, rights and warranty which the Constitution recognizes all citizens who live in the national territory.
