La finalidad principal del presente trabajo académico es la de analizar la procedencia de activar la justicia constitucional para tutelar derechos contemplados en la Constitución de materia tributaria, se realiza un estudio minucioso del contenido esencial que la Corte Constitucional del Ecuador ha expedido mediante la actual jurisprudencia sobre los principios constitucionales tributarios contenidos en el artículo 300 de la Constitución de la República, así mismo, se exponen las diversas características de la garantía jurisdiccional de acción de protección las cuales vuelven procedente la posibilidad de tutelar estos casos a través de la vía constitucional al ser ‘‘directa y eficaz’’. Por último, se demuestra que actualmente existe una grave confusión sobre la procedencia de tutelar casos mediante la justicia constitucional o la justicia ordinaria, por ende, este trabajo se enfoca en aclarar estas dudas y confusiones para obtener una mejor administración de justica constitucional en el país.
The main purpose of this academic work is to analyze the possibility of activating constitutional justice to protect cases that contain tax law features, a detailed study is made about the essential content that the Constitutional Court of Ecuador has issued through current jurisprudence of the constitutional tax principles that are contained in the article 300 of the Constitution of the Republic, in the same way, the characteristics of the jurisdictional guarantee of protection action are exposed, this characteristics make possible to protect the tax law cases through the constitutional justice because it is "direct and effective''. Finally, it is shown that nowadays exists serious confusion about the possibilities of protecting cases through constitutional justice or ordinary justice, therefore, this work focuses on clarifying these doubts and confusions to obtain a better administration of constitutional justice in the country.
