Este trabajo de investigación tiene como objetivo identificar los parámetros que rigen el uso de la fuerza policial, para delimitarlo y clasificarlo en debido o indebido según corresponda. El uso de la fuerza contiene pautas para su correcta aplicación, iniciando por amonestación verbal, posteriormente el uso de medios no letales y en el último de los casos, el uso de medios letales, pero siempre tratando de ocasionar el menor daño posible al presunto infractor. En este trabajo de investigación se realiza un estudio del concepto de uso progresivo de la fuerza, desde una percepción general hasta lo que la ley nacional e internacional estipula para llegar a establecer la existencia de estándares que dividen al uso de la fuerza en legitimo e ilegitimo. Dentro del desarrollo del presente trabajo, también se analiza la transición del uso debido al uso indebido, cómo actúan los agentes Policiales, y que errores se cometen para que sus actos dejen de enmarcarse como legítimos y se conviertan en ilegítimos. Con esa base, posteriormente se analiza tres casos relevantes suscitados en el Ecuador. Finalmente, se concluye que el uso letal de la fuerza solo se justifica en casos extremos y a mayor riesgo de daño por parte del agresor no legítimo y su actuación, mayor la autorización a las fuerzas policiales para incrementar los medios yendo de las simples amonestaciones a las acciones de neutralización.
This research work aims to identify the parameters that govern the use of police force, to delimit it and classify it as due or improper as appropriate. The use of force contains guidelines for its correct application, starting with verbal reprimand, then the use of non-lethal means and in the last case, the use of lethal means, but always trying to cause the least possible harm to the alleged offender. In this research work, a study of the concept of progressive use of force is carried out, from a general perception to what national and international law stipulates to establish the existence of standards that divide the use of force into legitimate and illegitimate. Within the development of this work, the transition of use due to improper use is also analyzed, how police agents act, and what mistakes are made so that their actions cease to be framed as legitimate and become illegitimate. On this basis, three relevant cases in Ecuador are subsequently analyzed. Finally, it is concluded that the lethal use of force is only justified in extreme cases and the greater the risk of harm on the part of the non-legitimate aggressor and his action, the greater the authorization to the police forces to increase the means going from simple reprimands to neutralization actions.
