El presente trabajo contiene un análisis exhaustivo con referencia al título valor “pagaré” y su validez jurídica –especialmente dentro de un juicio ejecutivo–, de qué forma ha sido tratado en la legislación ecuatoriana, cómo ha sido visto por los juristas ecuatorianos e internacionales cuando este por distintas razones ha sido otorgado en blanco, queriendo decir que el deudor aparentemente ha otorgado un documento para darlo en garantía, quedando así la parte acreedora con la facultad de completar el documento. Esta situación que sin duda ocurre abre una amplísima brecha para la observancia de un vacío legal imperante en nuestra legislación, al no existir norma expresa que regule claramente este acontecimiento en el tránsito mercantil, provocando en un sinnúmero de veces que el pagaré en blanco pueda ser usado en garantía llegando a parecer una cláusula abusiva cuando el acreedor actúa de mala, lo que podrá ser probado en juicio.
The present work contains an exhaustive analysis with reference to the title "promissory note" and its legal validity -especially within an executive judgment-, in what way it has been treated in the Ecuadorian legislation, how it has been seen by the Ecuadorian and international jurists when This for different reasons has been granted in white, meaning that the debtor has apparently granted a document to give it as a guarantee, thus leaving the creditor party with the power to complete the document. This situation that undoubtedly occurs opens a wide gap for the observance of a legal void prevailing in our legislation, since there is no express rule that clearly regulates this event in the commercial transit, causing countless times that the blank promissory note may be Used as a guarantee, it seems to be an abusive clause when the creditor acts bad, which may be proven in court.
