Una interpretación integral de la Constitución al estilo Dworkin : caso matrimonio igualitario en el Ecuador.

Este trabajo se desarrolla con dos objetivos y en dos momentos. Primero, la presentación de la postura que tenía respecto de la posibilidad jurídica de que el matrimonio igualitario fuere una realidad en el Ecuador aún antes de la expedición de las resoluciones de la Corte Constitucional ecuatoriana que dieron cabida a dicho matrimonio. Para tal efecto, había identificado la teoría constructivista de la interpretación de Dworkin como herramienta idónea para auscultar dicha posibilidad. La primera parte de este trabajo recoge, entonces, algunos presupuestos centrales de la teoría de Dworkin, para, a continuación, por medio de la perspectiva de los “desacuerdos teóricos” -también de Dworkin- determinar cuáles son los rasgos esenciales del ¨matrimonio¨. Y luego, siguiendo las etapas de interpretación de Dworkin, la construcción de lo que se considera la mejor interpretación posible de la definición de matrimonio contenida en el segundo inciso del artículo 67 de la Constitución. Y un segundo momento en el que se analizan las resoluciones emitidas por la Corte Constitucional, para identificar qué tipo de interpretación se ha utilizado y si cabe enriquecer dichas argumentaciones.
This paper is carried out with two objectives and in two moments. First, the presentation of the position I had -even before the issuance of the decisions of the Ecuadorian Constitutional Court that authorized same-sex marriage- regarding the constitutional possibility that said marriage would be a reality in Ecuador. For that purpose, I had identified Dworkin´s theory of constructive interpretation as an ideal tool to examine this possibility. So, the first part includes some central assumptions of Dworkin´s theory. Then, through Dworkin´s theoretical disagreements theory, the identification of what are the essential features of ¨marriage¨. And then, following the stages of Dworkin´s theory, the establishment of what could be considered the best possible interpretation of the definition of marriage contained in the second paragraph of article 67 of the Ecuadorian Constitution. And a second moment in which the resolutions issued by the Constitutional Court are analyzed, to identify what type of interpretation has been used and whether these arguments can be enriched.
