Previo a iniciar el proceso arbitral, cualquiera de las partes, puede solicitar medidas cautelares de carácter urgente, que no pueden esperar a la constitución de un tribunal arbitral, a fin de evitar una ejecución abusiva, mantener el status quo, proteger información o preservar pruebas. El árbitro de emergencia, es nombrado por los Centros de Arbitraje, para dictar medidas cautelares que prevengan estas situaciones. La Corte de Arbitraje de la Cámara de Comercio Internacional, acoge esta figura en el año 2012. En Ecuador, el 18 de agosto de 2021 a través del Decreto Nro. 165, se expide el reglamento a la Ley de Arbitraje y Mediación y se implementan las medidas cautelares. El presente trabajo, pretende realizar un análisis de la aplicación del Arbitraje de Emergencia dentro del ordenamiento jurídico ecuatoriano, a la luz del Decreto Nro. 165 expedido por el actual Presidente Constitucional de la República, Guillermo Lasso Mendoza.
Before starting the arbitration process, any of the parties may request urgent precautionary measures, which cannot wait for the constitution of an arbitral tribunal, in order to avoid an abusive execution, maintain the status quo, protect information or preserve evidence. The emergency arbitrator appointed by the Arbitration Centers to issue precautionary measures to prevent these situations. The Court of Arbitration of the International Chamber of Commerce welcomed this figure in 2012. In Ecuador, on August 18, 2021 through Decree No. 165, the regulation was issued to the Arbitration and Mediation Law and precautionary measures implemented. This paper aims to carry out an analysis of the application of Emergency Arbitration within the Ecuadorian legal system, in light of Decree No. 165 issued by the current Constitutional President of the Republic, Guillermo Lasso Mendoza.
