El Derecho es una de las ciencias sociales con más evolución en los últimos años, conceptos jurídicos que solían ser desarrollados bajo un precedente, tienden a evolucionar y cambiar el alcance del mismo. El presente trabajo de titulación a fin de poder obtener el título de abogado, se centra en su primer capítulo en un análisis de algunas de las Garantías Jurisdiccionales en la actualidad, junto a los precedentes que desarrollan las mismas, mientras qué, en la segunda parte de este trabajo, se procede a realizar un contraste de sentencias en la cual se constituye el abuso de derecho de estas garantías, al ser desnaturalizadas o planteadas incorrectamente, y conocer las posibles excepciones que pudieran existir desarrolladas en fallos jurisprudenciales, donde se realiza una ponderación entre el posible abuso de derecho y el objeto de la garantía, que como idea final, se individualiza si estas conductas que mantienen tanto los operadores de justicia como los accionantes, son en razón de un desconocimiento del la ley o actuaciones fraudulentas.
Law is one of the social sciences with the most evolution in recent years, legal concepts that used to be developed under a precedent, tend to evolve and change its scope. The present titling work in order to obtain the title of lawyer, focuses in its first chapter on an analysis of the Jurisdictional Guarantees at present, together with the precedents that develop them, while, in the second part of this work, a contrast of sentences is carried out in which the abuse of the right of these guarantees is constituted, when they are denatured or incorrectly raised, and to know the possible exceptions that could exist developed in jurisprudential rulings, where a weighting is made between the possible abuse of rights and the object of the guarantee, which as a final idea, is individualized if these conducts maintained by both the justice operators and the plaintiffs, are due to a lack of knowledge of the law or fraudulent actions.
