La participación del extraneus en los delitos usurpación de funciones públicas.

El Trabajo investigativo tiene como objetivo analizar la figura del extraneus en los delitos contra la administración pública, a través de una clarificación terminológica de definiciones tales como: extraneus; participación del extraneus; intraneus; similitud y diferencias entre el extraneus y el intraneus; delitos comunes, delitos especiales (propios e impropios; rol del extraneus en los delitos especiales impropios); delitos especiales de dominio; delitos de infracción de deber; y finalmente teoría de la ruptura del título de imputación y teoría de la unidad del título de imputación; para ello utilizaré criterios emitidos por varios tratadistas. También realizaré un análisis de la sentencia No. 17282-2016-04457 del Tribunal Penal de la Corte Nacional de Justicia de la sentencia, sobre el tipo penal del delito de cohecho, donde existen intraneus e extraneus para evidenciar la posición dogmática del Tribunal en torno a la responsabilidad penal del extraneus.
The investigative work aims to analyze the figure of the extraneus in crimes against the public administration, through a terminological clarification of definitions such as: extraneus; participation of the extraneus; intraneus; similarity and differences between the extraneus and the intraneus; common crimes, special crimes (proper and improper; role of the extraneus in improper special crimes); special domain crimes; offenses of breach of duty; and finally theory of the rupture of the title of imputation and theory of the unit of the title of imputation; For this I will use criteria issued by various writers. I will also carry out an analysis of sentence No. 17282-2016-04457 of the Criminal Court of the National Court of Justice of the sentence, on the criminal type of the crime of bribery, where there are intraneus and extraneus to evidence the dogmatic position of the Court regarding to the criminal responsibility of the extraneus.
