El trabajo consiste en evaluar la posibilidad de ampliar el derecho a recurrir los laudos arbitrales; en el Ecuador al día de hoy se puede impugnar el laudo arbitral a través de la acción de nulidad, pero esta de la forma que es concebida por la ley que regula el arbitraje en nuestro país, considero yo, es insuficiente. Esta insuficiencia surge, de la imposibilidad de recurrir los errores de derechos que podrían presentarse en un laudo arbitral. para esto se ha tomado como referencia normativa de otros países en los cuales el derecho a recurrir se ha aplicado exitosamente; estos países entre los cuales encontramos a; EE. UU., Reino Unido, Argentina e Italia, los cuales dentro de su normativa reconocen ya sea al nivel legal o dejándolo a disposición de las partes la configuración del derecho a recurrir. En el Ecuador el derecho a recurrir puede ser únicamente configurado a través de ley, por lo cual sería menester una revisión al artículo que compone la formas de recurrir al laudo arbitral.
The work consists of evaluating the possibility of expanding the right to appeal arbitral awards; in Ecuador today, the arbitration award can be challenged through an action for annulment, but this in the way that it is conceived by the law that regulates arbitration in our country, I consider, is insufficient. This insufficiency arises from the impossibility of appealing errors of rights that could arise in an arbitration award. for this, it has been taken as a normative reference from other countries in which the right to appeal has been successfully applied; these countries among which we find a; USA, UK, Argentina, and Italy, which within their regulations recognize either at the legal level or making it available to the parties the configuration of the right to appeal. In Ecuador, the right to appeal can only be configured through law, for which a review of the article that makes up the forms of appealing the arbitration award would be necessary.
