El presente trabajo tiene como finalidad, sugerir la implementación de la citación y ejecución notarial en los procesos civiles, en búsqueda de utilizar el acta notarial como un mecanismo de celeridad procesal permitiendo que la parte actora se asegure que el demandado ha sido citado y por otra parte el demandado podrá hacer uso de su derecho a la defensa que hasta ese punto ha sido vulnerado. Abordaremos los antecedentes de la citación, desde la doctrina y el Código Orgánico General de Procesos, también las funciones del notario y sus antecedentes históricos. Hemos considerado esta opción tomando en cuenta que el Notario es considerado como un auxiliar de la función judicial y un fedatario autorizado por lo tanto con su sola firma el juzgador podrá asegurarse que el proceso carece de vicios en cuanto a la citación de la parte demandada y si este no comparece al proceso será bajo su propia responsabilidad.
The purpose of this paper is to suggest the implementation of the summons and notarial execution in civil proceedings, seeking to use the notarial act as a mechanism of procedural speed allowing the plaintiff to ensure that the defendant has been summoned and on the other hand the defendant may make use of his right to defense that to that extent has been violated. We will address the background of the summons, from the doctrine and the General Organic Code of Processes, also the functions of the notary and his historical background. We have considered this option taking into account that the Notary is considered as an auxiliary of the judicial function and an authorized notary therefore with his sole signature the judge can ensure that the process lacks defects in terms of the summons of the defendant and if he does not appear at the process it will be under his own responsibility.
