La procedencia de los actos administrativos desfavorables en la revisión de oficio.

La Administración Pública, en virtud del principio de autotutela administrativa y en el ejercicio de la potestad de revisión, tiene la facultad de dejar sin efectos sus propios actos administrativos, cuyo contenido se encuentre viciado de una causal de nulidad a través de la institución de la revisión de oficio. La revisión de oficio es un procedimiento que permite a la máxima autoridad administrativa, ya sea por iniciativa propia o por insinuación de persona interesada, proceder en cualquier momento a la eliminación o invalidación de los actos administrativos nulos, sin intervención de la jurisdicción contencioso-administrativa. Sin embargo, ante el breve contenido sobre el procedimiento de la revisión de oficio estipulado en el Código Orgánico Administrativo, existe un vacío legal sobre cuál es el tipo de acto administrativo que será anulado por la Administración, abriendo al debate de si solo es procedente contra actos administrativos favorables o desfavorable, o inclusive ambas.

The ex officio review is a procedure that allows the highest administrative authority, either on its own initiative or at the suggestion of an interested person, to proceed at any time to the elimination or invalidation of invalid administrative acts, without the intervention of the contentiousadministrative jurisdiction. However, given the brief content on the ex officio review procedure stipulated in the Organic Administrative Code, there is a legal gap regarding the type of administrative act that will be annulled by the Administration, opening the debate on whether it is only appropriate against acts favorable or unfavorable administrative, or even both.
