El presente trabajo de titulación estudia la situación laboral actual de aquellos que se dedican a realizar envíos y entregas de bienes muebles, siendo este su rol de repartidor, manejándose a través de las relativamente nuevas y ampliamente populares aplicaciones digitales de delivery. Para esto habrá que comenzar delimitando los conceptos básicos del Derecho Laboral, que se encuentran en nuestra legislación ecuatoriana. A la par de esto, será también necesario revisar cómo se comprenden en la actualidad estas aplicaciones digitales, ya que varias de estas se han autodefinido para de esta forma presentar la imagen con la que se desean mostrar frente a sus potenciales usuarios. Y es así como luego se procederá a tratar el problema jurídico del tema, que se desarrolla con una discusión controversial sobre si los repartidores presuntamente autónomos, tienen una relación de dependencia con estas empresas.
This thesis studies the current employment relationship of those who are dedicated to pick-up and deliver movable property, portraying the role of a courier, doing so through these relatively new and widely popular delivery applications. For this we will have to begin by stablishing basic concepts about labour law, which can be found in Ecuadorian legislation. It will also be necessary to review how these apps came into fruition, mainly because they have self-proclaimed themselves as mere intermediaries, portraying this image to any of their potential clients. Afterwards we will proceed and discuss the legal problem of this work, that develops between alleged autonomous deliverers and their presumed employers, (delivery apps) with the main and final purpose which is to prove whether they share an employment relationship or not.
