El presente trabajo académico, tiene como objetivo principal poner en conocimiento a la sociedad, acerca de los problemas de aplicación de los tipos penales, que, en teoría fueron creados para la protección del medio ambiente y la naturaleza de la Ciudad de Guayaquil; sin embargo, dentro de la presente investigación, se mencionarán y se comentarán algunas leyes constitucionales, orgánicas y ordenanzas municipales; promulgadas a fin de garantizar el bienestar de las personas, atreves de la protección y creación de espacios ambientales sostenibles. Asimismo, se tratarán temas secundarios como: el origen y desarrollo de los derechos de la naturaleza en el ámbito internacional y en el ámbito constitucional ecuatoriano; la determinación de los problemas de aplicación, de los tipos penales que protegen el medioambiente de Guayaquil; y entre otros temas interesantes, que permitirán ilustrar a los lectores acerca de una perspectiva local, sobre la aplicación del Derecho Penal Ambiental en la Ciudad de Guayaquil. Por otro lado, uno de mis objetivos es mostrar someramente los índices de contaminación la Ciudad de Guayaquil, a fin de que los lectores de la presente tesis puedan hacer un examen de consciencia, y reflexionar sobre su conducta, para que la realidad tóxica de la ciudad pueda cambiar. Posteriormente, en la parte final del presente trabajo académico, expresaré mí criterio personal sobre ciertas soluciones para los problemas de aplicación, de los tipos penales que protegen el medio ambiente y naturaleza de la Ciudad de Guayaquil.
The main objective of this academic work is to bring to the attention the society, about the problems of application of the penal types, which, in theory, were created for the protection of the environment and the nature of the city of Guayaquil. However, within this research, some constitutional, organic and municipal laws and ordinances will be mentioned and discussed; Enacted in order to guarantee the wellbeing of the people, the protection and the creation of sustainable environmental spaces. It will also deal with secondary topics such as: The Origin and development of the rights of nature at the international and Ecuadorian constitutional level; The determination of the problems of application, of the penal types that protect the environment of Guayaquil; And among other interesting topics, that will allow to illustrate to the readers about a local perspective, on the application of the environmental penal Law in the city of Guayaquil. On the other hand, one of my objectives is to show briefly the indices of pollution the city of Guayaquil, so that the readers of this thesis can do a test of consciousness, and reflect on their behavior, so that the toxic reality of the city can Change. Later, in the final part of this academic work, I will express my personal criterion, on certain solutions for the problems of application of the penal types that protect the environment and nature of the city of Guayaquil.
