El presente trabajo de titulación tiene como objetivo analizar el régimen jurídico del silencio administrativo en el ámbito aduanero. La Constitución de la República del Ecuador reconoce el derecho de petición y asimismo, el Código Orgánico Administrativo que regula las actuaciones administrativas reconoce el derecho que obliga a la administración a responder motivada y oportunamente las peticiones del interesado. El silencio administrativo se encuentra fundamentado en el derecho de petición; y por ello, se establece, como regla general, con efectos estimatorios en los casos de inacción o falta de pronunciamiento por parte de la administración. Se analiza si en el ámbito aduanero dentro del recurso de revisión opera el efecto estimatorio del silencio administrativo, al contar actualmente en la ley de la materia, con un plazo máximo de resolución; en este punto, se analizan los requisitos del silencio administrativo y se constata que entre los requisitos existe la necesidad de que exista disposición legal expresa.
The objective of this titling work is to analyze the legal regime of administrative silence in the customs field. The Constitution of the Republic of Ecuador recognizes the right to petition and frequently, the Organic Administrative Code that regulates administrative actions recognizes the right that obliges the administration to respond promptly and promptly to the petitions of the interested party. The administrative silence is based on the right of petition; and for this reason, it is established as a general rule with appraisal effects in cases of inaction or lack of pronouncement by the administration. It is analyzed whether the estimated effect of administrative silence operates in the customs field within the appeal for review, since it currently has a maximum resolution term in the law on the matter; At this point, the requirements of administrative silence are analyzed and it is verified that among the requirements there is the need for an express legal provision.
