La Corte Interamericana de Derechos Humanos es un organismo del Sistema de Protección de Derechos Humanos de la región, emanado de la Convención Americana de Derechos Humanos, que tiene dos facultades, una contenciosa y una consultiva. El presente trabajo tiene por objeto el Análisis de la Opinión Consultiva Nro. 24 de la Corte IDH, para ello es indispensable analizar en primera instancia los Antecedentes de la Corte IDH y sus funciones, especialmente la Función Consultiva y que dice la Corte y la doctrina sobre su carácter vinculante. Posteriormente analizaremos los posibles efectos de esta opinión Consultiva en nuestra legislación, en el marco de Nuestra Constitución y de la jerarquía normativa, en ella establecida también analizaremos brevemente la resolución de la Corte Constitucional de junio 12 de 2019, al respecto; para concluir si fue legal y constitucional la aplicación de la Opinión Consultiva Nro. 24 de forma vinculante por la Corte Constitucional.
The Inter-American Court of Human Rights is an organism of the Human Rights Protection System of the Region, it emanates from the American Convention of Human Rights, which has two faculties, a contentious and an advisory. The purpose of this paper is the Analysis of the Advisory Opinion No. 24 of the Inter-American Court of Human Rights, therefore, it is essential to analyze in the first instance, the Background of the Inter-American Court and its functions, especially the Consultative Function according to the Court itself and the doctrine. Later we will analyze the possible effects of this consultative opinion in our internal laws, within the framework of our Constitution and in the normative hierarchy, we will also briefly analyze the resolution of the Constitutional Court of June 12, 2019, in this regard; to conclude whether the application of Advisory Opinion No. 24 was legally and constitutionally binding by the Constitutional Court
