En este estudio podemos analizar la motivación de la sentencia que constituye la parte importante donde el juez da su veredicto, su sana critica, las explicaciones que justifiquen su decisión durante el proceso, como se da la construcción de la premisa menor y mayor del silogismo judicial y de la realización de la actividad de corregir los hechos concretos en el supuesto abstracto de la norma y actividades que debe mantener siempre la sentencia, por ende esta siempre deberá estar motivada y realizarse a través de argumentaciones de hecho y derecho que explican las razones que tuvo el operador de justicia para aceptar o no la pretensión. En conclusión la parte dispositiva del fallo debe siempre ser el producto de una motivación donde da a conocer las razones que tiene el operador de justicia para la edificación de las premisas y la determinación de la consecuencia jurídica y en resultado tener una correcta resolución.
In this study we can analyze the motivation of the court sentences that constitutes an important part. where the judge gives his verdict, his sane critic, the explanations that justify his decision during the process, as is the construction of the minor and major premise of the judicial syllogism and the realization of the activity of verifying the concrete facts in the abstract assumption of the norm and activities that the judgment must always maintain, therefore this must always be motivated and carried out through arguments of fact and rights, that explain the reasons that had the justice operator to accept or not the claim. In conclusion the operative part of the ruling must always be the product of a motivation where it gives the reasons that the justice operator has for the construction of the premises and the determination of the legal consequence and as a result have a correct resolution.
