Prescripción de la acción de cobro de los procedimientos monitorios.

El presente ensayo académico tiene como fin el estudio del procedimiento monitorio que ha sido recientemente incorporado a la legislación ecuatoriana mediante el Código Orgánico General de Procesos. El artículo 356 del Código Orgánico General del Procesos, otorga al actor la potestad de ejercer su acción de cobro mediante un procedimiento monitorio, siempre que la deuda no exceda de los cincuenta salarios básicos unificados, y siempre que exista algún documento que pruebe la existencia de la deuda, sin embargo en la normativa referente a los procedimientos monitorios, el legislador ha omitido establecer cuál será el tiempo de prescripción de la acción de cobro, y además, en vista de que es un proceso nuevo en la legislación ecuatoriana, no existe una norma clara que establezca cual será el tiempo de prescripción aplicable.
The objective of this academic essay is the study of the monitoring procedure that has recently been incorporated into the Ecuadorian legislation through the General Organic Code of Processes. The Article 356 of the General Organic Code of Processes grants the plaintiff the option to exercise his right to charge a debt, if this debt do not exceed fifty unified basic salaries, and whenever there is a document that proves the existence of the debt, but in the legislation regarding to the monitoring procedures, the legislator has omitted to establish what will be the time of prescription of the right to charge the debt, and in addition, since this a new process in Ecuadorian legislation, it does not exist a clear rule that establishes what time of prescription the plaintiff should use.
