Constitucionalmente el servicio notarial es un servicio público, que forma parte de manera auxiliar de la Función Judicial y lo rige el Consejo de la Judicatura para su organización, control, régimen económico, disciplinario y determinación de tasas entre otros aspectos importantes. Parte de este Servicio Notarial se ejecuta por el Sistema Informático Notarial de la Función Judicial que fue diseñado para brindar celeridad, eficacia y eficiencia a la ciudadanía que solicita los servicios notariales en el país y que entró en funcionamiento en el año 2015 luego de las respectivas regulaciones y reformas que la Constitución de la República del Ecuador el Código Orgánico de la Función Judicial, la Ley Notarial y las Resoluciones del Consejo de la Judicatura han realizado para el efecto, no obstante con todo este proceso de modernización llevado a cabo existe la necesidad de implementar las opciones necesarias adicionales que garanticen el acceso en línea de la información de los actos notariales en el Ecuador, para que los usuarios puedan obtener copias certificadas de archivo, sin necesidad de trasladarse de un cantón a otro y desde cualquier parte del país con las debidas seguridades ahorrando tiempo y dinero, garantizando una mayor agilidad, eficiencia y eficacia en la tramitología de las mismas, razón por la cual se ha desarrollado la presente investigación, con la finalidad de generar una propuesta que permita obtener una solución a esta problemática.
Constitutionally, the notarial service is a public service, which is an auxiliary part of the Judicial Function and is governed by the Council of the Judiciary for its organization, control, economic and disciplinary regime and determination of rates among other important aspects. Part of this Notarial Service is executed by the Notarial Computer System of the Judicial Function that was designed to provide speed, effectiveness and efficiency to the citizens who request notarial services in the country and which came into operation in 2015 after the respective regulations and reforms that the Constitution of the Republic of Ecuador, the Organic Code of the Judicial Function, the Notarial Law and the Resolutions of the Council of the Judiciary have carried out for this purpose, however with all this modernization process carried out there is a need to implement the necessary additional options that guarantee online access to the information of notarial acts in Ecuador, so that users can obtain certified file copies, without the need to move from one canton to another and from any part of the country with due security, saving time and money, guaranteeing greater agility, efficiency and effectiveness in the processing of the same, which is why this research has been developed, in order to generate a proposal that allows obtaining a solution to this problem.
