El presente trabajo de investigación tiene la finalidad de dar a conocer que por medio de la responsabilidad se puede reparar el daño ambiental que tanto personas naturales o jurídicas pueden cometer contra el medio ambiente. Cuando se da un daño ambiental por parte del contaminador nace la responsabilidad de parte del Estado de reparar el daño causado, sancionar al contaminador y definir sistemas de prevención para así poder evitar la existencia de otros daños al medio ambiente. Con el paso de los años, la naturaleza es constantemente víctima de daños ambientales, como la contaminación de ríos, riachuelos y esteros, tala indiscriminada de árboles y desechos químicos que pueden afectar a los seres humanos y al medio ambiente. Es por ello, de la importancia de nuestras leyes de prevenir y remediar el daño que se produce por causas ambientales a la naturaleza para así proteger el bienestar de los recursos naturales y por supuesto la salud de las personas. La responsabilidad en el Ecuador es un tema ineficiente ya que aún le falta claridad a nuestra legislación, ocasionando así que los daños y problemas hacia el medio ambiente no se resuelvan de manera inmediata.
The purpose of this research work is to show that by means of liability it is possible to repair the environmental damage that both natural and legal persons can commit against the environment. When an environmental damage is caused by the polluter, the State is responsible for repairing the damage caused, sanctioning the polluter and defining prevention systems in order to avoid the existence of other damages to the environment. Over the years, nature is constantly victim of environmental damage, such as the contamination of rivers, streams and estuaries, indiscriminate felling of trees and chemical waste that can affect people or the environment. That is why it is so important for our laws to remedy the damage that is produced by environmental causes to nature in order to protect the welfare of natural resources and of course the health of people. While it is true that liability has already been used in some Latin American countries, in Ecuador, this issue still lacks much clarity within our legislation, thus causing the damage and problems to the environment are not solved immediately.
