La tenencia o custodia del menor, como se lo conoce en otros países, se desarrolla dentro de la rama del derecho de familia, niñez y adolescencia. Por lo tanto, las disposiciones de este concepto jurídico las encontramos en el Código de la Niñez y Adolescencia, en su Título III. Esta figura jurídica por lo general se aplica mediante un conflicto legal que deriva ante la protección y cuidado de un menor. Por ello, el primer capítulo se tratará las generalidades del tema, como definiciones, características, elementos, clasificaciones, entre otros. En el segundo capítulo se analizará la problemática jurídica; de aquello, se desarrollará con fundamento las soluciones debidas. Es menester comparar la problemática en derecho comparado, pues en efecto, se fortalecería el criterio y motivación de la tenencia compartida, ya que por ningún momento se deberá interrumpir, violar o afectar el interés superior del menor, principio fundamental del derecho de la niñez y adolescencia.
The possession or custody of the child, as it is known in other countries, takes place within the branch of family, children's and adolescent law. Therefore, the provisions of this legal concept are found in the code of children and adolescents, in Title III. This legal figure is usually applied through a legal dispute arising from the protection and care of a minor. Therefore, the first chapter will cover the generalities of the topic, such as definitions, characteristics, elements, classifications, among others. The second chapter will discuss the legal issue; of that, the right solutions will be developed on the basis. It is necessary to compare the problem in comparative law, since in fact, the criterion and motivation of shared tenure would be strengthened, since for no time should the best interests of the child be interrupted, violated or affected, a fundamental principle of the law of children and adolescents.
