En el proceso penal ecuatoriano, existen tres tipos de medios probatorios; la prueba documental, la prueba testimonial y la prueba pericial. El presente trabajo versa sobre la prueba documental, en específico sobre aquella que contenga contenido digital. Al momento del dictamen, serán las pruebas la base sobre la cual estará fundamentada la motivación del juez. Por ello dichas pruebas deben cumplir con los criterios de valoración determinados en el Código Orgánico Integral Penal. Uno de esos criterios es el sometimiento a la cadena de custodia. A lo largo de este trabajo investigativo veremos que en la valoración de la prueba documental de contenido digital, también surge la necesidad de su sometimiento a cadena de custodia, y que el incumplimiento de la misma, produce tal nivel de afectación que conllevaría a tildar de ineficaz a su validez probatoria.
In the Ecuadorian penal system there are three types of evidence: documented, testimonial and expert. The below piece of work delves into documented evidence, specifically documented evidence that is digital. When the judge gives his sentence, it will be based upon and motivated by evidence. Because of this, these evidences must adhere to and comply with the valuation criterion determined in the Integrated Organic Penal Code. One of the criteria is submitting to the custody chain. This investigative work will showcase that in the valuation of documented digital evidence, this too must be submitted to the custody chain. Not complying to this would further diminish and take value away from the evidence.
