En el año 1998 la Corte Interamericana de Derechos Humanos esgrimió por primera vez el concepto del proyecto de vida y el daño al mismo. A pesar de esto y de diversas sentencias por parte de la misma Corte que lo han considerado como elemento dentro de la reparación integral inmaterial, la Corte no le ha otorgado una definición concreta, dejándolo como término jurídico indeterminado. A su vez la doctrina le ha otorgado ciertos parámetros, pero al igual que la Corte Interamericana de Derechos Humanos, no ha podido esgrimir un alcance conciso del daño al proyecto de vida. La legislación ecuatoriana ha recogido el daño al proyecto de vida en diversos cuerpos legales, pero asimismo ha fallado en darle una definición concreta, a la vez que producto de eso los jueces se han limitado en su aplicación, por lo que es vital un desarrollo legislativo y jurisprudencial del tema para que se pueda brindar una completa reparación integral a las víctimas.
In 1998, the Inter-American Court of Human Rights put forward the concept of the life project and the damage to it for the first time. Despite this and various judgments by the Court itself that have considered it as an element within the integral non-pecuniary reparation, the Court has not granted it a specific definition, leaving it as an indeterminate legal term. In turn, the doctrine has given it certain parameters, but like the Inter-American Court of Human Rights, it has not been able to wield a concise scope of the damage to the life project. Ecuadorian legislation has included the damage to the life project in various legal bodies, but it has also failed to give it a concrete definition, as a result the judges have limited their application, so legislative and jurisprudential development of the subject is vital so that a complete integral reparation can be offered to the victims.
