La presente investigación implica un análisis desde la óptica constitucional acerca de los derechos establecidos para proteger y garantizar la integridad de las personas privadas de libertad, desde los ámbitos educativos, laborales, de salud, productivos, culturales, alimenticios y recreativos con el fin de que la rehabilitación y la reinserción social se desarrollen de manera efectiva en base al correcto cumplimiento de los derechos próximos a desarrollarse en el presente trabajo. Actualmente en el Ecuador, las condiciones de vida de las personas privadas de libertad se han visto afectadas por algunos factores evidenciando el incumplimiento de los derechos y limitando el sistema penitenciario, el cual atraviesa una crisis de naturaleza estructural, normativa y social. El Estado Ecuatoriano debe perfeccionar tanto leyes, como reglamentos y políticas públicas que brinden una efectividad a corto, mediano y largo plazo para la población carcelaria y post carcelaria.
The present investigation consists of an analysis from the constitutional point of view about the rights established to protect and guarantee the integrity of persons deprived of liberty, from the educational, labor, health, productive, cultural, food and recreational fields in order to rehabilitation and social reintegration are developed effectively based on the correct fulfillment of the rights that are to be developed in this work, likewise. Currently in Ecuador, the living conditions of people deprived of liberty have been affected by some factors, evidencing the breach of rights and limiting the prison system, which is going through a crisis of a structural, normative and social nature. The Ecuadorian State must perfect both laws, regulations and public policies that provide effectiveness in the short, medium and long term for the prison and post-prison population.
