Los códigos de convivencia escolar en el Ecuador en su mayor parte incluyen normas que limitan la apariencia física de sus estudiantes, amenazando con sanciones disciplinarias, académicas e inclusive físicas. Estas normas regulan desde el largo del cabello, hasta el color y largo de las uñas, perforaciones, tatuajes, color del cabello, etc. Estas medidas restrictivas limitan la posibilidad de los estudiantes de expresar y desarrollar su personalidad libremente, en su lugar favoreciendo la nula expresión de características que diferencien a los estudiantes como individuos únicos e irrepetibles. Estas medidas estimamos vulneran el derecho al libre desarrollo de la personalidad de los estudiantes, que reciben constantemente actos de represión en caso de no seguirlas, inclusive llegando a prohibirles el acceso a la educación y a tratos denigrantes, avalados por los códigos de convivencia y las autoridades de las instituciones educativas. Actualmente el derecho al libre desarrollo de la personalidad no ha tenido un desarrollo extenso en el derecho ecuatoriano, situación que ha derivado en que las autoridades del ministerio de educación e incluso el sistema judicial sean meros observadores del problema sin tomar medidas al respecto, perpetuando las vulneraciones a los estudiantes que siendo menores de edad deberían ser protegidos con prioridad.
School regulations in Ecuador for the most part include rules that limit the physical appearance of the students, threatening with sanctions that go from disciplinary, academic to even physical ones. This norms regulate the hair length, its color, nail style and color, tattoos, piercings, etc. These restrictive rules limit the possibility of the student to develop and express their personalities freely, instead favoring the null expression of traits that differentiate students from one another as unique individuals. These measures we believe infringe each student’s right to a free development of their personality, students which receive constant acts of repression in the case of not abiding to them, even going as far as to denying them the access to an education and degrading treatments endorsed by the school regulations and the school authorities. At present the right to a free development of personality is hardly developed at all in the Ecuadorian law system, situation that has led to the authorities at the ministry of education and even the judicial system to be spectators of the problem without taking any action about it, perpetuating the violation the student’s rights, students that being minors should be protected with priority.
