El Comité de Empresa de la Corporación Nacional de Telecomunicaciones CNT EP interpuso una acción de protección en contra de la empresa pública a razón de que solicitaban que se declare la vulneración derechos a los servidores públicos de la institución debido a que los empleados administrativos no fueron incluidos en el contrato colectivo inicial que firmaron ambas partes y que delimitaba como beneficiarios a quienes ostenten la calidad de obreros; siendo que ambos grupos tienen una regulación legal diferente en los que respecta al tratamiento de su relación laboral (Código del Trabajo y Ley Orgánica de las Empresas Públicas). A pesar de esto, el juez que conoce la causa les da la razón a los representantes del Comité de Empresa y, mediante sentencia, declara la vulneración de derechos y ordena el pago de los haberes y beneficios obtenidos, incluso con efecto retroactivo. Es así que se analiza el posible abuso del derecho por parte de quién tiene la potestad de impartir justicia bajo diversos parámetros y el no fallar en contra de norma expresa.
The Company Committee of the National Telecommunications Corporation CNT EP filed a protection action against the public company on the grounds that they requested that the violation of the rights of the public servants of the institution be declared due to the fact that the administrative employees were not included. in the initial collective agreement signed by both parties and which defined as beneficiaries those who hold the status of workers; being that both groups have a different legal regulation regarding the treatment of their employment relationship (Labor Code and Organic Law of Public Companies). Despite this, the judge who hears the case agrees with the representatives of the Company Committee and, through a ruling, declares the violation of rights and orders the payment of the salaries and benefits obtained, even with retroactive effect. Thus, the possible abuse of the right by who has the power to impart justice under various parameters and not failing against the express norm.
