Actualmente, las empresas fintech son una opción innovadora para atraer inversión y generar ingresos en la economía de un país, debido a su aspecto tecnológico encaminado al ofrecimiento de servicios financieros a la sociedad, de una forma rápida, segura y eficaz; no obstante, la legislación ecuatoriana no ha incluido dentro de sus líneas la implementación de este tipo de instituciones financieras, las mismas que ya vienen ofreciendo estos servicios sin que haya una regulación normativa respecto del funcionamiento de estas. El funcionamiento de estas instituciones va en aumento y el derecho -que debe ir evolucionando con las sociedades- no ha modernizado los aspectos necesarios para poderle dar un lugar dentro de la legislación interna a este tipo de servicios. Se propone la implementación del proyecto de ley Fintech como un mecanismo modernizador e innovador para el estado ecuatoriano en calidad de servicios auxiliares a la luz del Código Orgánico Monetario y Financiero.
Currently, fintech companies are an innovative option to attract investment and generate income in the economy of a country, due to their technological aspect aimed at offering financial services to society, in a fast, safe and efficient way; however, the Ecuadorian legislation has not included within its regulations the implementation of this type of financial institutions, even though they are already offering these services without there being a normative regulation regarding their operation. Finthech companies operating are increasing and the law -which must evolve with societies- has not modernized the necessary aspects to be able to give a place within the internal legislation for this type of services. The implementation of the fintech bill is proposed as a modernizing and innovative mechanism for the Ecuadorian state as auxiliary services according to the Organic Monetary and Financial Code.
