El presente documento de análisis, tiene como propósito tratar la problemática sobre la imposición de penas privativas de libertad en mujeres embarazadas, que cumplen sentencia en el Centro de Privación de Libertad Cotopaxi N° 1, ubicado en el cantón Latacunga durante el año 2020; lo que vulnera el ejercicio de sus derechos constitucionales, pues ninguna mujer embarazada puede ingresar a un centro de privación a cumplir la pena sino noventa días después del parto, o si el embarazo sobrevino a la pena privativa de libertad se deben preferir medidas alternativas, para este último caso no existe un trámite en el régimen penitenciario. Al no existir un trámite en la normativa penal vigente que garantice sus derechos y encontrándose en vigencia normativa reglamentaria que regulariza la estadía de las mujeres gestantes privadas de libertad en los centros carcelarios, ésta es contraria no solo a la normativa penal vigente y a los tratados internacionales de derechos humanos. Es necesaria la regulación de un trámite adecuado para la tutela de los derechos de las mujeres embarazadas privadas de libertad que garantice el debido proceso y la seguridad jurídica.
The purpose of this analysis document is to address the issue of the imposition of custodial sentences on pregnant women, who are serving a sentence at the Cotopaxi Center for the Deprivation of Liberty No. 1, located in the Latacunga canton during 2020; This violates the exercise of their constitutional rights, since no pregnant woman can enter a detention center to serve her sentence until 90 days after delivery, or if the pregnancy occurred after the custodial sentence, alternative measures should be preferred, to In the latter case, there is no procedure in the penitentiary regime. As there is no procedure in the current criminal regulations that guarantees their rights and the regulatory regulations that regulate the stay of pregnant women deprived of liberty in prisons are in force, this is contrary not only to current criminal regulations and international treaties of human rights. It is necessary to regulate an adequate procedure for the protection of the rights of pregnant women deprived of liberty that guarantees due process and legal security.
