La aplicación del COA a los procedimientos sancionatorios del Consejo de la Judicatura.

La actuación de la Función Judicial se encuentra regulada por el Código Orgánico de la Función Judicial, dentro de la norma orgánica en mención se establece el Régimen Disciplinario para los funcionarios judiciales y particulares, encontrándonos con la particularidad que en su artículo 119 niega la facultad de recurrir las decisiones tomadas por el Pleno del Consejo Nacional de la Judicatura en materia disciplinaria. Posteriormente se expide el Código Orgánico Administrativo, dentro de su ámbito de aplicación regula el ejercicio de la Función Administrativa del Sector Público incluyendo la Función Judicial, dentro del cual encontramos el procedimiento administrativo sancionador, el cual reconoce la facultad de interponer recursos en sede administrativa. ¿Será viable la aplicación del COA a los procedimientos Sancionatorios del Consejo de la Judicatura? ¿El contenido de Art. 119 del COFJ es inconstitucional?.
The performance of the Judicial Function is regulated by the Organic Code of the Judicial Function, within the organic norm in mention establishes the Disciplinary Regime for the public workers and individuals, in its article 119 denies the faculty to appeal the decisions taken by the Plenary Session of the National Council of the Judiciary in disciplinary matters. Subsequently, the Administrative Organic Code is issued, which within its scope of application regulates the exercise of the Administrative Function of the Public Sector, including the Judicial Function, within which we find the sanctioning administrative procedure, which recognizes the power to lodge appeals at the administrative headquarters. Will the application of the COA to the sanctioning procedures of the Judicial Council is viable? Is the content of Art. 119 of the COFJ unconstitutional?.
