En la presente investigación, se analiza uno de los derechos del hombre contemplados en diferentes instrumentos internacionales, que se ha adaptado conforme el desarrollo de la sociedad, es decir, el derecho a la intimidad que por su importancia debe contar con mecanismos normativos que garanticen su eficacia, debido cumplimiento y su correcta interpretación jurisprudencial. Está constitucionalmente reconocido en Ecuador, en donde el individuo decide quien tiene acceso a conocer aspectos que involucran la vida privada, información referente al ámbito profesional, personal y familiar, es por esto, que se debe garantizar su plena protección y defensa frente a la intromisión de terceros, inclusive del Estado mismo. La inclusión y avance de la tecnología ha significado un cuestionamiento a la intimidad, y dado a esta existe en la actualidad mayor exposición, lo que lleva a cuestionar la protección efectiva del sujeto. Existen varios factores, situaciones y hechos que obligan a crear nuevos mecanismos o medidas concretas para la defensa de este y que de esta manera los individuos tengan su esfera e integridad personal totalmente garantizada y puedan tener una vida y bienestar pleno.
In the present investigation, one of the rights of man contemplated in different international instruments is analyzed, which has been adapted according to the development of society, that is, the right to privacy, that due to its importance must have regulatory mechanisms that guarantee its effectiveness, due compliance and its correct jurisprudential interpretation. It is constitutionally recognized in Ecuador, where the individual decides who has access to know aspects that involve private life, information regarding the professional, personal and family environment, which is why their full protection and defense against intrusion must be guaranteed. From third parties, including from the State itself. With the advancement of technology, the concept of protection has opened a barrier that allows privacy to be violated more and more, so there is greater exposure. There are several factors, situations and facts that require the creation of new mechanisms or concrete measures for the defense of this and that in this way individuals have their sphere and personal integrity fully guaranteed and can have a life and full well-being.
