En materia migratoria cada Estado es soberano al momento de determinar qué requisitos de ingreso y permanencia exigir a los extranjeros que busca ingresar al país, pero el diseño constitucional y legal de la política migratoria puede ser discriminatoria cuando se exigen requisitos distintos a extranjeros que se encuentran en una misma situación de hecho, como sucede con la imposición del requisito de visa consular a los ciudadanos venezolanos, y se excluye del mismo a los ciudadanos provenientes de la CAN. En el presente trabajo se realiza un análisis del principio constitucional de libre movilidad humana, donde se concluye que existe discriminación respecto a los venezolanos, así como un trato desigual que no se justifica jurídicamente y que genera xenofobia, rechazo a nivel social e institucional, y hechos de devoluciones masivas prohibidas por el Derecho internacional y la propia Constitución ecuatoriana.
In immigration matters, each state is sovereign in determining what requirements it will impose on the entry and residence of foreigners seeking to enter its country. However, the constitutional and legal design of immigration policy can be discriminatory when different requirements are imposed on foreigners who are in the same factual situation, as is the case with the imposition of consular visa requirements on Venezuelan citizens, while citizens of the website CAN are excluded from them. In this paper, I will conduct an analysis of the constitutional principle of free human mobility for the abovementioned citizens, concluding that there is discrimination against Venezuelans, as well as unequal treatment that is not legally justified and that generates xenophobia, rejection at the social and institutional level, and acts of massive repatriation prohibited by international law and the Ecuadorian Constitution itself.
